Jurisprudential Analysis of The Permanent Immigration of Elites And the Legal Requirements To Curb It From The Point of View of Public Policy

Abstract

One of the current basic challenges of the Islamic society of Iran is the increase in the rate of immigration of the elites and their failure to return to the country, which naturally causes great damage to the structures that are developing and progressing in the second step of the revolution. The necessity and importance of the above issue requires that its jurisprudential ruling be measured based on the generality of jurisprudential rules and evidence and the viewpoint of contemporary jurists.The following article tries to imitate by using the study of documents and consulting the great authorities.By analyzing the primary and secondary jurisprudential rules of the permanent migration of the elites, will provide strategies for governance policies with the above phenomenon. According to the findings of the research, the approach of jurisprudence on the permanent migration of elites is duty-oriented and collectivist, not just human right. The generalities and applications of evidence, such as the rule of Nafye Sabil,Taarab after migration,the Sireh-e- Shariah and Sireh-e- wise, If the conditions for the development of elites in the Islamic society are provided, as a social right or a Sharia obligation, they are obliged to provide services to Muslims. In lack of support from relevant institutions, the government is the guarantor.Based on this, the government should take a role model from the Sireh-e- Imams in dealing with the companions and elites, even if they have religious weaknesses, and make appropriate public policies for the benefit of the Islamic society in this field.
